PolyHour Terms of Service
Effective from 22 October 2026 · This is a translation; the Polish version prevails · Privacy Policy · Home page · Open PolyHour
§ 1. General provisions
- These Terms set out the rules for using the PolyHour app and for purchasing the Pro version. They are the terms and conditions referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means.
- The Service Provider is Dominik Pańko, Gdańsk, Poland, doing business under the name PolyHour. Contact: support@polyhour.app. We provide an address for paper correspondence on request sent to this email address.
- The Terms are available free of charge, also before an agreement is concluded, at polyhour.app/terms.html (English) and polyhour.app/pl/terms.html (Polish), in a form that allows them to be downloaded, saved and printed.
- The User accepts the Terms when creating an Account (by ticking the box or confirming sign-in with a Google account). Before that, the User may read the Terms and the Privacy Policy without creating an Account.
- An Account may be created by an adult. A minor may use the App with the consent of their legal representative.
§ 2. Definitions
- App – PolyHour: the Windows program, the browser app (including on iPad) and the polyhour.app website.
- User – a person who uses the App.
- Consumer – a User who is a consumer within the meaning of Article 221 of the Polish Civil Code, as well as a natural person running a business who concludes a contract that is not directly related to their business and is not of a professional nature for them (Article 38a of the Polish Consumer Rights Act).
- Account – the User's account in the App, created with an email address or a Google account.
- Free version – the free-of-charge scope of the App's features, with the limitations described on the home page.
- Pro – paid access to all features of the App on an Account, purchased as a Subscription or a Lifetime Licence.
- Subscription – Pro for a period of one week, one month or one year, renewed automatically.
- Lifetime Licence – Pro purchased with a single payment, without renewal, for as long as the PolyHour service is provided.
- Stripe – Stripe, Inc. and the companies in its group that accept payments for Pro as the seller (merchant of record).
§ 3. Services
- Among other things, the App lets you measure working time, plan tasks, manage projects, calculate earnings and create reports (CSV, PDF), and in the Windows version also automatically count the time spent in selected programs.
- The User's data is stored on their device and synchronised between their devices via the cloud (Google Firebase).
- Optional integrations (e.g. Google Calendar, Discord) work under the terms of those services; the User may disconnect them at any time. Google Calendar and other features marked with a padlock are available in Pro.
- The free version is free of charge. During the testing period (beta), the Service Provider may make all features available free of charge; the end of the testing period does not delete the User's data.
- The Service Provider may change features of the App that are not necessary to keep it in conformity with the contract, for justified reasons (development of the App, security, changes in the law or in external services), at no additional cost to the User. If a change significantly and negatively affects access to Pro or its use, we inform the User about it in advance by email, and the Consumer may terminate the contract within 30 days of the change (or of being informed about it, if later) and receive a refund proportional to the unused period of Pro.
§ 4. Technical requirements
- To use the App you need: Internet access, an active email address or Google account, and one of the following: a computer with Windows 10 or 11 (64-bit) or an up-to-date browser (Chrome, Edge, Firefox or Safari, including on iPad) with JavaScript enabled.
- The App stores data locally on the device (browser storage or a file in the Windows user folder). The polyhour.app website does not use cookies for tracking.
- Using the Internet involves typical risks (e.g. malware, password theft). We recommend an up-to-date system, antivirus software and a strong password that you do not use anywhere else.
§ 5. Account
- Creating an Account is free of charge. The agreement for the use of the App is concluded when the Account is created, for an indefinite period.
- The User may terminate the agreement at any time, without giving a reason, by deleting the Account in the App (Settings → Data Management → Delete account) or by writing to support@polyhour.app; see account deletion. Deleting the Account permanently deletes the data.
- The User keeps their login details confidential and does not share them with others. The Service Provider is not liable for actions taken on the Account by persons to whom the User has given their login details.
- If a User flagrantly violates the Terms (§ 6), the Service Provider may, after an unsuccessful request to stop the violations, block access to the Account or terminate the agreement with 14 days' notice; in the case of actions that threaten the security of the App – immediately. We give the reason by email. Before the Account is deleted, the User may export their data.
- The Service Provider may stop providing the App for important reasons, informing Users by email at least 6 months in advance and allowing them to export their data. Unused, paid periods of a Subscription are then refunded proportionally.
§ 6. Rules of use
- The User shall use the App in accordance with the law and the Terms. In particular, it is prohibited to:
- provide content of an unlawful nature;
- attempt to circumvent security measures, the limits of the free version or the payment mechanism;
- take actions that overload or disrupt the operation of the App and its infrastructure;
- resell access to Pro or make it available to third parties.
- The App, its name, logo and appearance are protected by copyright. The User receives a non-exclusive, non-transferable right to use the App for their own needs for the duration of the agreement. The licences of open-source components are listed in the App (Settings → About → Open source licences).
- Data entered by the User belongs to the User, who may export it at any time (CSV, PDF).
§ 7. Pro version and payments
- Pro unlocks all features of the App on the Account, including full history, statistics, multiple currencies, integrations and PDF reports without a watermark, on the computer, in the browser and on iPad. The current scope and prices are given in the price list.
- Prices are gross prices (they include VAT) and are given in Polish zloty or US dollars, depending on the currency chosen at purchase.
- The purchase takes place on the Stripe payment page, opened from the App. Stripe accepts the payment as the seller (merchant of record), issues the proof of purchase and settles taxes; the Pro service itself is provided by the Service Provider. Withdrawal from the contract (§ 9) and complaints (§ 10) may in any case be submitted directly to the Service Provider. Card details and other payment data are processed only by Stripe, under its own terms; the Service Provider does not receive them.
- The contract for the purchase of Pro is concluded when the order is paid for on the payment page, after clicking the button that indicates an obligation to pay. The proof of purchase arrives by email.
- The available payment methods are shown on the Stripe payment page (e.g. payment cards, BLIK, digital wallets).
- Pro is switched on for the Account from which the purchase was started, usually a few seconds after payment. If this does not happen within an hour, write to support@polyhour.app.
- The Service Provider may make discount codes available on the terms stated when they are issued. Whenever we announce a price reduction, we also give the lowest price from the 30 days before the reduction.
§ 8. Subscriptions and cancellation
- A Subscription renews automatically for another period of the same length, and the fee is charged at the start of each period until the User cancels it. A Subscription has no minimum term.
- A Subscription can be cancelled at any time in the App (Settings → About → Manage subscription), via the link in the message from Stripe, or by writing to support@polyhour.app. After cancellation, Pro works until the end of the paid period and no further fee is charged.
- When Pro ends, the Account moves to the free version. Data is not deleted; some of it (e.g. older history) may be hidden until Pro is purchased again. The connection to Google Calendar is disconnected at that point.
- The Service Provider may change the price of a Subscription only for important reasons: an increase in the costs of providing the service (servers, payment processing), a change in taxes, or inflation, or a significant extension of the Pro features. We inform the User about the change by email at least 14 days in advance. The new price applies from the first period that begins after the change; before then, the User may cancel the Subscription at no cost. We do not change the price of a Lifetime Licence that has been purchased.
§ 9. Right of withdrawal
- A Consumer may withdraw from the contract for the purchase of Pro within 14 days of the day it was concluded, without giving a reason and without incurring any costs.
- To withdraw from the contract, it is enough to send a statement to support@polyhour.app before the deadline expires, giving the Account's email address. You may use the model form, but this is not obligatory.
- We refund the entire amount paid without undue delay, and no later than 14 days after receiving the statement, using the same payment method, unless the Consumer agrees to a different one (at no additional cost). After withdrawal, Pro on the Account ends.
- The right of withdrawal applies to the conclusion of the contract for the purchase of a given plan. The automatic renewal of a Subscription can always be cancelled before it takes place (§ 8(2)).
§ 10. Complaints
- The Service Provider is liable to the Consumer for the conformity of the App and Pro with the contract under the rules of Chapter 5b of the Polish Consumer Rights Act.
- Complaints can be submitted to support@polyhour.app. Please give the Account's email address, a description of the problem and the solution you expect.
- Complaints may also be sent by post, to the address we provide on request (§ 1(2)).
- We respond within 14 days of receiving a complaint. If we do not respond within that time, the complaint is deemed accepted.
- The Service Provider is liable for a lack of conformity that occurs or becomes apparent during the whole period in which Pro or the App is provided.
- If Pro does not conform to the contract, the Consumer may demand that it be brought into conformity with the contract, which we do within a reasonable time and at no cost to the Consumer. The Consumer may demand a price reduction or withdraw from the contract if bringing it into conformity is impossible or would require excessive costs, if we have not brought it into conformity, if the lack of conformity continues despite our attempts, or if it is so significant that it justifies an immediate price reduction or withdrawal. Withdrawal is not possible if the lack of conformity is insignificant.
- We refund the amount due after a price reduction or withdrawal without undue delay, no later than 14 days after receiving the Consumer's statement, using the same payment method. After withdrawal, we refund the price for the period in which Pro did not conform to the contract and for the unused period.
- Complaints about the payment itself (e.g. a double charge) can also be submitted to Stripe via the link in the proof of purchase.
§ 11. Liability
- We make every effort to ensure that the App works without interruptions and errors. Short technical breaks are possible, especially during updates.
- The Service Provider is not liable for interruptions caused by force majeure or by services it has no influence over (e.g. the User's Internet provider). This does not limit the Consumer's rights under § 10.
- Calculations in the App (e.g. hourly rate, earnings, quotes) are based on the data entered by the User and are for guidance; they are not financial or tax advice. We recommend exporting your data regularly (CSV, PDF).
- Towards Users who are not Consumers, the Service Provider's liability is limited to the amount paid for Pro in the last 12 months and does not cover lost profits.
- The provisions of the Terms do not exclude or limit the Consumer's rights under mandatory provisions of law.
§ 12. Personal data
The rules for processing personal data, including the controller's details, the purposes, legal bases, recipients (Google Firebase, Stripe) and the User's rights, are described in the Privacy Policy.
§ 13. Changes to the Terms
- The Service Provider may change the Terms for important reasons, in particular: changes in the law, changes in the scope or manner of providing the services, changes to the price list, security reasons or the need to remove ambiguities.
- We announce changes by email to the Account's address, on this page and in the App at least 14 days before they take effect. A User who does not accept the changes may terminate the agreement at no cost before that date (delete the Account, cancel the Subscription).
- Pro purchases made before a change are governed by the Terms as worded on the day of purchase, until the end of the paid period.
§ 14. Final provisions
- Polish law applies to contracts concluded under the Terms. This choice of law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- The Consumer may use out-of-court means of handling complaints and pursuing claims, including the assistance of a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or a provincial inspectorate of the Trade Inspection (Inspekcja Handlowa). Information: prawakonsumenta.uokik.gov.pl.
- Disputes with Users who are not Consumers are resolved by the court competent for the Service Provider's place of business; disputes with Consumers – by the court competent under the general rules.
- The Terms are available in Polish and English. In the event of discrepancies, the Polish version prevails.
- These Terms are effective from 22 October 2026.
